1. Acceptance of Terms
By accessing or using Auction Hawk ("the Service"), available at auctionhawk.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Auction Hawk is operated from the United Kingdom. These terms are governed by and construed in accordance with the laws of England and Wales.
2. Description of Service
Auction Hawk provides automated auction bidding (sniping) services for eBay auctions. The Service places bids on your behalf at times you specify, using eBay's official API. The Service requires you to authorise access to your eBay account via eBay's OAuth 2.0 authorisation flow.
We do not guarantee that any bid placed through our Service will be successful. Auction outcomes depend on factors outside our control, including network latency, eBay server performance, and competing bids.
3. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old.
4. eBay Account Authorisation
The Service requires authorisation to access your eBay account via eBay's official OAuth 2.0 flow. When you connect your eBay account, you are redirected to eBay's website to grant permission. We never see, store, or request your eBay password.
You may revoke Auction Hawk's access to your eBay account at any time through your eBay account settings. Revoking access will prevent the Service from placing bids on your behalf.
5. Bidding and Liability
Bids placed through the Service are legally binding on eBay. You are solely responsible for the bids you instruct the Service to place, including the maximum bid amounts and timing parameters you set.
Auction Hawk is not liable for any losses, damages, or costs arising from: failed bid placements due to technical issues; winning a bid at a price you consider too high (up to your set maximum); eBay account restrictions or suspensions; or changes to eBay's API or policies.
6. Fees and Payment
The Service offers both free and paid subscription tiers. Current pricing is displayed on our website. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Paid subscriptions are billed monthly or annually as selected. You may cancel your subscription at any time; access continues until the end of the current billing period.
7. Refund Policy
We offer a full refund within 14 days of the initial subscription purchase. After this period, no refunds are provided for the remaining billing period. Free-tier users have no payment obligations.
8. Prohibited Use
You agree not to:
- Use the Service to violate eBay's terms of service or any applicable law
- Create multiple accounts to circumvent free-tier limitations
- Attempt to reverse-engineer, decompile, or hack the Service
- Use the Service for shill bidding or any form of auction fraud
- Share your account credentials with third parties
9. Data Protection
We process your personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
10. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be announced in advance where possible. We are not liable for losses caused by service downtime.
11. Termination
We reserve the right to suspend or terminate your account if you breach these terms. You may delete your account at any time from your account settings. Upon termination, all scheduled snipes will be cancelled.
12. Changes to Terms
We may update these terms from time to time. Material changes will be notified via email to registered users. Continued use of the Service after changes constitutes acceptance of the updated terms.
